TERMS OF USE

Welcome to Bridge, a digital platform dedicated to share content and training elements, as well as the storage of information regarding gastroenterology (hereinafter referred to as the “Platform”). This Platform was developed for and published by Mayoly Spindler (hereinafter referred to as the “Company” or “We”) for a community of selected users: the Bridge community.

This Platform is hosted by MAYOLY SPINDLER DE MÉXICO, S.A. DE C.V.  with its registered office located at Patriotismo 587 Piso 6 Colonia Nochebuena Del. Benito Juarez, México D.F. C.P. 03720.

Given the nature of the information shared and of the training offered, the use of the Platform, available at www.bridge-meeting-point.com, is reserved to members of the Bridge community.

This Platform is thus intended to allow the members to:
- Share information and useful services;
- Store content available from any computer, digital tablet or smartphone;
- Disseminate information that contributes to the continuous training of its members.

This Platform defends the values of tolerance and respects the rights of third parties. All content on this Platform protected by intellectual property rights, is confidential and reserved exclusively to the members of the Bridge community. In case of non-compliance with the provisions of the present Terms of Use, access to the Platform will be suspended or cancelled.

 
ACCESS TO THE PLATFORM

To access and use this Platform, you must be a member of the Bridge community and receive your own login and password issued by Mayoly Spindler, at your first connection.

Access to the Platform is only allowed under these conditions.

Furthermore, members must at first login, read and accept the present Terms of Use its provisions without reserve.


In order to validate registration and to create a profile, the members will have or shall be invited to fill in certain required fields in a form, indicated as such by an asterisk, prior entering the Platform. Any inaccurate or incomplete registration will be refused.

Members confirm that the data submitted and stored in the information systems is accurate and acts as proof of their identity. Please inform the Company as to any changes in such data.

Moreover, access to the Platform shall require the use of personal access codes. It is the member’s responsibility to ensure the confidentiality of such codes that can of course be changed at any time. Please inform the Company of any fraudulent use that you may become aware of.

Even though we try to keep this Platform accessible permanently, we cannot guarantee its access under all circumstances. In fact, in some particular situations such as maintenance, updating, or other reasons that are beyond our control, access to the Platform may be interrupted.

 
INTELLECTUAL PROPERTY

As a user of the Platform, members declare and warrant that they hold the rights, the powers and the necessary authorizations on the content they submit, post, publish, share or display to the other members on the Platform or by any means, including via hyperlinks or comments that are posted (hereinafter referred to as the “User Content”).

We remind members that before publishing any content on the Platform where a third party is involved, the necessary rights should have been obtained (i.e. publications/photographs/videos). If the necessary rights have not been granted to submit such content, it will be at the entire liability of the member.

The Company will not be held responsible or liable for any damages resulting from the use of the User Content in accordance with these Terms of Use.

Members retain all rights on all User Content. From the first diffusion on the Platform, the member expressly grants the Company and other users of the Bridge Platform a worldwide, non-exclusive, royalty free license, for the term of legal copyright protection as currently acknowledged by French legislation, on the User Content, including a right to sublicense such rights to third parties.

This consent is given for all reproduction, representation or adaptation, exclusively for internal or external education and/or institutional communication purposes directly linked to the project Bridge, organized by Mayoly Spindler and for any other non-commercial and non-advertising use, on multimedia systems, digital, computer and/ or electronic format known to date, and paper based formats.

The Platform is also enriched with content and information published by the Community Manager of the Company. The Platform and its content (such as trademarks, images, text, videos, etc.) are protected by intellectual property rights. The development of this Platform represents a significant investment and work from our team.

On certain exceptional and very occasional cases, we may expressly authorize members to reproduce and/or represent all or part of the Platform, to certain media. Any request for authorization in this regard must be submitted in advance to the community manager e-mail address: community.manager@bridge-meeting-point.com

 
USER CONTENT

As a user of the Platform, members will be able to share content with other members of the Bridge community. For this reason, the following rules shall be respected.
 

MODERATION RULES

The User Content published and shared with the Bridge community may be monitored; thus, all comments after publication may be subjected to some post moderation.

If the content does not comply with the present terms, the moderator reserves the right to delete it, especially if the content is:

· Illegal or illicit;

· Injurious, obscene, defamatory, malicious and/or that may incite to violence, discrimination, xenophobia and/or racism;
· Not respectful of the privacy and/or rights of others (including image rights and intellectual property rights);
· Politically oriented and/or with proselytizing purposes; 

· In non-compliance with the present Terms of Use. 

 
RIGHTS AND DUTIES OF THE CONTRIBUTOR

Any contributors are prohibited from using the Platform (i) for intimidating or harassing anyone, (ii) for diverting from its purpose, in particular, by using it as a dating space, or (iii) as a vehicle for advertising or promote content.

The Company requests that all contributors ensure they comply with the courtesy necessary for the proper conduct of the discussions in this Platform.

 
RIGHTS AND DUTIES OF THE READER

Any reader who reads a comment must comply with the intellectual property rights of its author.

Members are invited to notify the Company in case any comment and/or content might be contrary to applicable laws and/or to morality and/or are contrary to the principles of this Terms of Use at the community manager address: community.manager@bridge-meeting-point.com

 
RESPONSIBILITY

With the help of its Community Manager, Mayoly Spindler will make all efforts to update the content of the Platform and to deliver unbiased and accurate information to the users. However, it cannot guarantee the total accuracy, precision or completeness of the data present on the Platform. Consequently, Mayoly Spindler shall not be liable for any inaccuracy or omission relating to the information available on the Platform, as well as for any damages resulting from a fraudulent intrusion by a third party which can lead to a modification of these information.

CONFIDENTIALITY

By using this Platform, members undertake to keep strictly confidential any information described as such, relative, in particular, to the activities and the products of the Company or of any affiliates, which members may have learned by consulting or taking part in this Platform, with the exception of the information already made publicly available.

 
DATA STORAGE

In order to ease the content availability, a data storage service has been implemented through the Bridge Platform, hosted by Terre Lib Santé. For this reason, members will be able to store any content desired (text, PowerPoint, videos, pictures etc.) and access it from anywhere and from any digital support: computer, digital tablet and/or smartphone.

The Company reminds members that the content uploaded to this data storage service is solely their responsibility.

The private content stored (when not shared with the rest of the Bridge community) shall be only available to the owner, and shall not be accessible to the other users of the Platform, including the Community Manager of the Company, neither to the Company. On the contrary, the information shared on the Platform shall be available to all the members of the Bridge community. The Company reminds members that it is their own responsibility to manage and protect this content by not disclosing logins and passwords to any third parties. Mayoly Spindler shall not be liable for any loss or deterioration of personal content or of the cost and expenses eventually associated to the back-up or the restoration of all or part of this content.

 
PUBLICATION OF NAMES / PHOTOGRAPHS / VIDEOS

By accessing the Platform and accepting the present Terms of Use, users allow the Company, with no charge, to publish photographs and/or videos where they appear, as along with their name, on the Platform, which shall be available to the others users.

PERSONAL DATA

Members’ personal data is processed byTerre Lib Santé for the purposes of Platform management.

This information provided by members will only serve to fill in their Platform profile. It may also be used by Mayoly Spindler andTerre Lib Santé for the management of the Platform.

In accordance with applicable data privacy laws, members have the right to access, object for legitimate reasons, or correct their personal data. This right can be exercised at any time, by sending an email, with proof of identity, to the community manager address community.manager@bridge-meeting-point.com

 
MODIFICATION OF THE PLATFORM AND AMENDMENTS OF THE TERMS OF USE

The Company may revise the content and information included on this Platform and modify the present Terms of Use, in order to comply with applicable new legislation and/or regulation and/or to improve the Platform functioning. Any modification and/or amendment shall be integrated into the present Terms of Use.

By continuing to access or use the Platform, after any such revisions, members agree to be contractually bound by the revised Terms of Use.

 
APPLICABLE LAW

The present Terms are governed by the French Law. In case of any claim, assignment of jurisdiction is made to the courts of Paris.
